Terms of Service Agreement

These Terms of Service (“Terms”) govern your access to and use of the services provided by Gogolook Co., Ltd. (“Gogolook,” “we,” “our,” or “us”). By accessing or using the service (the “Service”), you (“Client,” “you,” or “your”) agree to be bound by these Terms. If you do not agree, you must not use the Service.\nThese Terms supplement and operate in addition to the Whoscall Terms of Service (“Main Whoscall TOS”). If there is any inconsistency or conflict between these Terms and the Main Whoscall TOS, the Main Whoscall TOS shall prevail unless these Terms expressly provide otherwise with respect to the Service described herein.
1. Service Description
Gogolook provides caller identification and related services, including but not limited to displaying business names, trademarks, product descriptions, and other information to end users via phone number(s) you register.
2. Client Responsibilities
2.1 Rights to Information
  • You represent and warrant that any information you provide (including trademarks, company names, product descriptions, and personal data) is accurate and that you have the full legal right and authority to use, disclose, and license such information to Gogolook for the purpose of providing the Service.
  • If a third party claims that your provided information infringes its rights:
    • Gogolook may suspend or restrict access to the Service for the relevant phone number(s) until the dispute is resolved.
    • You are solely responsible for any damages payable to the third party.
    • You will indemnify and compensate Gogolook for any losses we incur as a result of such claims.
2.2 Valid Phone Numbers
  • You guarantee that each phone number you register for the Service is legally owned or licensed to you.
  • You agree that Gogolook or a third-party auditor designated by Gogolook may verify your ownership or licensing of these numbers. You must provide valid supporting documents when requested and allow Gogolook to retain copies.
  • If your evidence becomes invalid or a third-party claim arises:
    • Gogolook may suspend the relevant phone number(s) until valid evidence is provided or the dispute is resolved.
    • You remain solely responsible for any third-party damages and will indemnify Gogolook for related losses.
3. Fees and Payment
  • Service fees are as stated in the quotation or pricing page applicable to your account. All invoices must be paid within thirty (30) days unless otherwise specified or as otherwise agreed in writing.
  • You must confirm the required phone numbers and related information at least ten (10) business days before your Service launch date or as otherwise agreed in writing between you and Gogolook.
  • If payment is overdue, Gogolook may suspend or terminate your access to the Service without refund or compensation for any downtime.
4. Change Requests and Additional Charges
If you request changes to the displayed information or other materials after your Service is live, a setup fee of THB 100 per change per phone number (or such other fee as may be agreed in writing between you and Gogolook) applies.
5. Use of Your Logo and Name
By using the Service, you grant Gogolook a non-exclusive, royalty-free license to display your company name and logo on our official website and other marketing materials solely to identify you as a client. Gogolook will not use your branding for any other purpose, nor transfer, reproduce, adapt, lend, or sublicense it to third parties. If we misuse your branding in violation of this section and cause you harm, we will be responsible for any resulting damages.
6. Suspension and Termination
We may suspend or terminate your access to the Service without liability or refund if:
  • You violate these Terms;
  • A third-party claim or legal dispute arises regarding the information or phone numbers you provide; or
  • You fail to pay fees on time
7. Disclaimers
  • The Service is provided “as is” and “as available.” Gogolook makes no warranties, express or implied, regarding uninterrupted or error-free operation.
  • Gogolook shall not be liable for any indirect, incidental, special, or consequential damages.
8. Limitation of Liability
Except for liabilities arising from misuse of your branding (Section 6) or your indemnification obligations (Sections 3.1 and 3.2), Gogolook’s total liability under these Terms is limited to the amount you paid to Gogolook for the Service in the twelve (12) months preceding the event giving rise to the claim.
9. Governing Law and Disputes
These Terms are governed by the laws of Thailand. Any dispute will be subject to the exclusive jurisdiction of the courts of Thailand.
10. Updates to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice (for example, by posting the revised Terms on this page with a new “Last updated” date). Continued use of the Service after changes means you accept the updated Terms.
